By creating an account on Pointly ("the Service"), you ("you" or "the User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms constitute a legally binding agreement between you and Pointly ("we," "us," or "our"). Please read them carefully before using the Service.
You must be at least 18 years of age to create a parent account on Pointly. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
Children may use Pointly only under the direct supervision and consent of a parent or legal guardian who holds a Pointly account. Parents are responsible for all activity that occurs under child accounts they create, including ensuring that children's use of the Service is appropriate and supervised.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these acceptable use provisions.
Pointly is a family points and rewards application. Parents award tokens to children, children spend tokens to earn points, and children redeem points for rewards chosen by the family.
All points, tokens, and rewards within Pointly are virtual and exist solely within the context of the Service. Points and tokens have no monetary value, cannot be exchanged for cash, and cannot be transferred outside the Pointly platform. Rewards are defined by parents and are fulfilled by the family outside of the application — Pointly does not provide, deliver, or guarantee the fulfillment of any reward.
Pointly offers a free tier and a paid auto-renewable subscription, Pointly Plus, billed either monthly ($3.99 USD per month) or yearly ($29.99 USD per year). The price and billing period shown at the point of purchase are authoritative and may vary by region, currency, and applicable taxes. How your subscription is billed, renewed, and canceled depends on the platform you purchase from, as described below.
Apple App Store (iOS). Subscriptions purchased through the Pointly iOS app are processed by Apple as in-app purchases. The following terms apply:
Web and Android. Subscriptions purchased through our website or the Android app are billed via Stripe, our third-party payment processor. The following terms apply:
The free tier is always available. Canceling a paid plan reverts your account to the free tier with its associated limits.
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes, but we are not liable for any modification, suspension, or discontinuation of the Service.
We may perform maintenance that temporarily affects the availability of the Service. We will endeavor to schedule maintenance during off-peak hours when possible.
To the fullest extent permitted by applicable law, Pointly and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for all claims arising out of or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or ten dollars ($10.00), whichever is greater.
The Service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or expectations.
You may terminate your use of the Service at any time by deleting your family account through the application settings. Upon deletion, all data associated with your account and any child accounts in your family will be permanently removed in accordance with our Privacy Policy.
We may suspend or terminate your account at any time if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or if your use of the Service poses a risk to other users or to the operation of the Service. We will make reasonable efforts to notify you of any suspension or termination, but we are not required to do so in cases involving security concerns or legal obligations.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including, without limitation, Limitation of Liability, and Governing Law) will survive.
We may update these Terms from time to time. If we make material changes, we will notify you by sending an email to the address associated with your parent account at least 30 days before the changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
The "Last updated" date at the top of this page indicates when these Terms were last revised.
These Terms shall be governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in the State of Maine, and you consent to the personal jurisdiction of such courts.
